Terms of Service

These Terms of Service (the "Terms") govern your access to and use of TileForge (the "Service"), operated by the TileForge team ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. Accounts

You must be at least 13 years old to use the Service. You are responsible for keeping your password confidential and for every action taken from your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate any account that violates these Terms, abuses the Service, or remains inactive for more than 18 months.

2. Your Content & Ownership

You retain all rights to the tilesets, palettes, frames, and pixel art you create with the Service ("Your Content"). We do not claim ownership of Your Content.

You grant us a limited, non-exclusive, royalty-free license to host, store, transmit, and display Your Content solely to operate the Service (rendering it back to you, generating tilesets on your behalf, and providing export downloads).

You are responsible for ensuring you have the right to upload any reference images or palettes you use. You may not upload content that infringes third-party copyright, trademarks, or other rights.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to harass others.
• Attempt to gain unauthorized access to other accounts or our infrastructure.
• Scrape, mirror, or systematically extract data from the Service beyond what the API expressly permits.
• Resell, sublicense, or white-label the Service without a separate written agreement.
• Upload malware, spam, or content that depicts illegal acts.

4. Subscription & Billing

Paid plans are billed in advance per fixed 30-day period at the price in effect when you start a period. There is no automatic renewal — each period is a discrete prepaid charge that you authorize by initiating checkout. Re-pay before the period ends to extend without interruption, or let it lapse to revert to the Free tier.

All charges are final and non-refundable. Because you only ever pay for periods you explicitly choose to start, we do not process refunds, partial refunds, or pro-rated credits for any reason, including unused time within a paid period, accidental purchase, change of mind, dissatisfaction, account termination, or service outages. The Free tier exists so you can fully evaluate the product before paying. By initiating a Pro checkout you confirm you have evaluated the product and accept this no-refund policy.

Prices may change with at least 30 days notice; changes apply only to new periods started after the notice window, not to periods already in progress.

5. Free Tier

The free tier is offered as-is and may be modified, restricted, or discontinued with 30 days notice. We encourage you to export your work periodically.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, ship updates, or experience outages without prior notice for emergencies.

7. Termination

You may delete your account at any time from your profile page. Account deletion is immediate and irreversible — all projects, pixels, and metadata are permanently removed.

We may terminate or suspend your account for material breach of these Terms or for activity that materially harms the Service or other users.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from your use of the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 50.

We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operating entity is registered, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts of that jurisdiction.
